Agreement to Terms

By downloading, installing, or using the Radius Disc Golf mobile application on Apple iOS (from the Apple App Store) or Android (from the Google Play Store), or by using our website at radiusdiscgolf.com (together, the "Services," and the mobile applications, the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.

Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

Use of the App

Radius grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Reverse engineer, decompile, or disassemble any part of the App
  • Attempt to gain unauthorized access to the App's systems or other users' accounts
  • Use automated systems (bots, scrapers, crawlers, etc.) to access, index, or interact with the Services, or access the Services or any data made available through them (including via our application programming interfaces or underlying data stores) other than through the interfaces we provide and in the manner permitted by these Terms
  • Copy, extract, harvest, scrape, reproduce, republish, distribute, sell, license, or otherwise make available any course data, database content, or other content from the Services, in whole or in any material part, except as expressly permitted by these Terms
  • Use any content, course data, or database from the Services to create, populate, train, or improve any competing product, service, dataset, or machine-learning or artificial-intelligence model, or for any commercial purpose
  • Interfere with or disrupt the integrity or performance of the App
  • Upload or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable

Subscriptions and Payments

Radius offers an optional paid subscription, Radius Pro, which unlocks additional features. The following terms apply to all subscriptions:

  • Billing through the app store. Subscriptions purchased in the App are billed through, and managed by, the app store you purchased from — the Apple App Store on iOS or Google Play on Android. Payment is charged to your store account at confirmation of purchase.
  • Auto-renewal. Subscriptions automatically renew for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within 24 hours prior to the end of the current period.
  • Managing and canceling. You can manage or cancel your subscription at any time in your app store account settings (Apple ID subscription settings on iOS, or Google Play subscriptions on Android). Deleting the App does not cancel a subscription.
  • Price changes. We may change subscription prices. Where required, the relevant app store will notify you and seek your consent before a price increase takes effect.
  • Refunds. Except where required by law or by the applicable app store's policies, payments are non-refundable. Refund requests are handled by Apple or Google in accordance with their policies.

Automated and Machine-Learning Features

The App includes automated features such as Caddy disc recommendations, Radius Rating scoring, the Disc Scanner, and personalized Learn content. These features provide suggestions and analysis based on available data and are intended for informational and entertainment purposes only. Radius does not guarantee the accuracy or completeness of any recommendation or result. You use these features at your own discretion. Caddy recommendations in particular are informational suggestions only and are not guaranteed; you remain responsible for your own shot selection, disc choice, and course strategy at all times.

User-Generated Content

You retain ownership of content you create and share through the App — including posts, comments, forum threads, course reviews, and the photos and Stories you upload. By posting or uploading content, you grant Radius a worldwide, non-exclusive, royalty-free license to host, store, use, display, reproduce, adapt, and distribute that content within the Services — including showing your photos and Stories to other users as part of the features you post them to — and for promotional purposes. You are solely responsible for the content you post, represent that you have the rights necessary to post it, and must not post content that infringes the intellectual property or other rights of others.

Objectionable Content and Zero Tolerance

Radius has zero tolerance for objectionable content and abusive behavior. This applies to all user-generated content across the Services — including Stories, Discover and community posts, comments, course reviews, course and layout submissions, and league and event names — and to how you treat other users.

You agree not to create, upload, post, submit, or share any content that is unlawful, obscene, pornographic, hateful, harassing, bullying, threatening, defamatory, discriminatory, violent, or otherwise objectionable, and not to harass, abuse, threaten, impersonate, stalk, or intimidate any other user. You can report objectionable content and block or report abusive users using the tools provided in the app.

We review reports of objectionable content and abusive behavior and act on them, typically within 24 hours — removing the content and, where warranted, suspending or permanently terminating the responsible account. We may remove any content and suspend or terminate any account that violates these Terms, with or without notice, at our sole discretion. There is no tolerance for objectionable content or abusive users on the Services.

Course and Database Contributions

Radius is a community-built database. When you submit, upload, or edit course information — including course names, locations, layouts, hole and tee data, descriptions, ratings, photographs, and similar material (collectively, "Contributions") — you represent and warrant that: (a) you have all rights necessary to make the Contribution and to grant the license below; (b) the Contribution consists of factual information and/or your own original work; and (c) the Contribution does not copy proprietary content (such as original written descriptions, photographs, or other original material) from any third party, and does not infringe any intellectual property right or violate the terms of service of any other platform or service.

You grant Radius a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to host, store, use, reproduce, modify, adapt, display, and distribute your Contributions as part of the Services and the Radius database. Because Contributions become part of a shared community database that other users rely on, this license survives deletion of your account with respect to Contributions already incorporated into the database.

Radius is a collaborative, community-built database. Course and layout information you submit may be reviewed, corrected, edited, expanded, or replaced by other contributors, and is shared with and relied upon by the wider Radius community. You should not expect a Contribution to remain unchanged, attributed to you, or private once it has been submitted to the shared database.

Ownership of the Radius Course Database

While each contributor retains rights in their own individual Contribution as described above, the Radius course database as a whole — including its compilation, selection, coordination, arrangement, structure, and the aggregated collection of course names, locations, layouts, hole and tee data, distances, ratings, reviews, photographs, and related information — is a proprietary database owned by Radius Disc Golf and is protected as a compilation under copyright and applicable database, contract, and unfair-competition laws. Your use of the Services does not transfer to you any ownership of, or any license to reuse, the compiled database.

Except with our prior written permission, you may not, and may not permit, assist, or enable any third party to: (a) copy, extract, harvest, scrape, mirror, download, reproduce, republish, distribute, sell, license, or otherwise make available any material portion of the course database or other Radius content; (b) create any derivative work from, or build or populate any product, service, dataset, or database that incorporates or is derived from, the course database or Radius content; (c) use the course database or Radius content to develop, train, or improve any competing product or service, or any machine-learning or artificial-intelligence model; or (d) access the course database or Radius content other than through the interfaces we provide for ordinary personal, non-commercial use. This section applies regardless of the means used, whether automated or manual, and survives termination of your account or these Terms.

Community Guidelines

When using community features (Discover feed, forums, local meetups), you agree to:

  • Treat other users with respect
  • Not post spam, misleading content, or unsolicited advertising
  • Not harass, bully, or threaten other users
  • Not impersonate other individuals or entities

Radius reserves the right to remove content and suspend or terminate accounts that violate these guidelines at our sole discretion.

Intellectual Property

The App and its original content (excluding individual user-generated content), features, and functionality are owned by Radius Disc Golf and are protected by copyright, trademark, and other intellectual property laws. This ownership includes the compiled Radius course database — its structure, selection, and arrangement — as described in "Ownership of the Radius Course Database" above: individual contributors retain rights in their own Contributions, but the aggregated database as a compilation is owned by Radius. The Radius name, logo, and all related marks are trademarks of Radius Disc Golf.

Third-Party Services

The App may integrate with or link to third-party services (e.g., mapping and satellite imagery, weather data providers, and cloud infrastructure such as Google Firebase). Your use of these services is subject to their respective terms and privacy policies. Radius is not responsible for the content or practices of any third-party services.

App Stores

You obtain the App from, and your use of the App is also subject to the rules of, the app store from which you downloaded it.

Apple App Store (iOS). If you downloaded the App from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and Radius only, not with Apple, and Apple is not responsible for the App or its content.
  • Apple has no obligation to furnish any maintenance or support services for the App.
  • In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims by you or a third party relating to the App, including product-liability, legal/regulatory, or intellectual-property claims.
  • Your use of the App must comply with the Apple Media Services Terms and Conditions and the App Store Usage Rules.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you.

Google Play (Android). If you downloaded the App from Google Play, your use of the App is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App or its content.

Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Radius does not warrant that the App will be uninterrupted, error-free, or free of harmful components. Disc golf involves physical activity and inherent risks — always exercise caution and good judgment on the course regardless of any recommendations provided by the App.

Limitation of Liability

To the fullest extent permitted by law, Radius Disc Golf shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or related to your use of the App.

Indemnification

You agree to indemnify, defend, and hold harmless Radius Disc Golf and its members, officers, employees, and agents from and against any claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) any content or Contributions you submit to or share through the Services; (b) your violation of these Terms; (c) your violation or infringement of any intellectual property or other right of any third party; or (d) your violation of any applicable law or of the terms of service of any third-party platform or service. Radius reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with Radius's defense.

Termination

We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice. Upon termination, your right to use the Services will immediately cease. You may delete your account and associated data at any time directly within the App at Settings → Delete Account on both iOS and Android, or by contacting us.

Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

Dispute Resolution; Arbitration; Class-Action Waiver

Please read this section carefully. It affects your legal rights, including your right to bring a lawsuit in court and to participate in a class action.

Informal resolution first. Before starting an arbitration or other formal proceeding, you and Radius agree to first try to resolve any dispute informally for at least 60 days. To begin, email a written description of the dispute and your contact information to info@radiusdiscgolf.com. This good-faith step is a required precondition to filing a claim.

Binding arbitration. If the dispute is not resolved informally, you and Radius agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding, individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except as provided below. The arbitration may be conducted by telephone, by video, based on written submissions, or in person in the Commonwealth of Massachusetts, at your election. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Exceptions. Either party may (1) bring an individual claim in small-claims court if it qualifies, and (2) seek injunctive or other equitable relief in court to stop actual or threatened infringement or misuse of intellectual property or unauthorized access to the Services.

Class-action waiver. You and Radius agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding.

Coordinated or mass filings. If 25 or more similar claims are asserted against Radius by or with the assistance of the same or coordinated counsel, the claims will be administered in staged batches to control costs, and you and Radius will cooperate with the AAA to implement such batching.

Your right to opt out. You may opt out of this arbitration agreement and class-action waiver within 30 days of first accepting these Terms by emailing info@radiusdiscgolf.com with your name, the email address on your account, and a clear statement that you opt out of arbitration. Opting out will not affect any other provision of these Terms.

This section survives termination of your account or these Terms. If any portion of this section is found unenforceable, the remainder will remain in effect — except that if the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court rather than arbitration.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-law principles. Subject to the "Dispute Resolution; Arbitration; Class-Action Waiver" section above, any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in the Commonwealth of Massachusetts, and you consent to the personal jurisdiction of those courts, except where applicable law gives you the right to bring proceedings in your country of residence.
